NEW RULES FOR RESIDENCE REGISTRATION ARE COMING INTO FORCE

The new law on residence registration came into force

On December 01, 2021 the Law of Ukraine On Provision of Public (Electronic Public) Services on Residence Declaration and Registration in Ukraine" under No. 1871-IX dated 05.11.2021 came into force.

This Law has significantly changed the rules of registration of the place of residence in Ukraine:

  • annulment of the stamp in passports and paper registration certificates

Information on place of residence contained in the old-type passport (in the form of a booklet) will no longer be taken into account. For holders of passport documents in the form of an ID-card, certificates of place of residence registration/deregistration will no longer be issued. Information on residence registration will only be contained in electronic registers and the result of the registration/deregistration service will be sent by email. Residence registration will now have to be confirmed through Diya application.

  • registration of children under 18 years shall be made only with parental consent

Children aged 14 to 18 can now register their place of residence only with parental consent. An exception to this is registration in a dormitory of an educational institution.

  • registration of children aged 14 and over shall be made only with a passport

Children aged 14 and over can register their place of residence only with a passport, not with a birth certificate.

  • registration of foreigners with a notarised passport accompanied by translation

In addition to the residence permit, foreigners will need a copy of the internal passport accompanied by a Ukrainian translation.

  • registration of foreigners' children with a birth certificate

The registration of foreigners' children will now require a notarized copy of their birth certificate accompanied by a Ukrainian translation, in addition to a residence permit.

  • mandatory filing of TIN code
  • A tax number is now included in the list of documents for residence registration as compulsory, and its absence must be proved by appropriate documens.
  • increase in the amount of the administrative fee

Residence registration fee is now 34 UAH 05 kopeks, in case of overdue registration (more than 30 days) - 56 UAH 75 kopeks.

These are the new rules for residence registration in Ukraine and Kyiv in 2022.

So far, practical implementation of the new legislation has encountered some difficulties. For example, in order to obtain a TIN, the fiscal service requires a residence registration, which in turn requires a TIN. There are also many issues regarding the lack of paper certificates on place of residence registration/deregistration. Many authorities and organisations continue to require such certificates. In addition, individuals and organisations do not have access to the register of registered persons, just as many people do not have smartphones or have not installed the Diya app.

Perhaps the law will be amended to consider the practicalities, but in the meantime the registration authorities and their clients rely on the explanations provided to them by the management.
